Child custody can be a very sensitive time for families, especially the children. Child custody issues do not only occur during a divorce, but also can occur long after a divorce has been finalized, and even sometimes for parents who have never married.
Please note that there are more issues to consider if you are having child custody issues with someone you have never been married to. The law in Georgia states that a father who has never been married to the mother of the child at issue IS NOT THE LEGAL FATHER! For more information, please see the Legitimation Section.
Many parents think that there is only one type of custody, but there are actually two types of custody which are "physical" and "legal", and both types of custody have to be determined by a Superior Court Judge in every child custody case. This almost always means that you WILL have to go to court and be subjected to the rules of evidence, which can impose very critical restraints on your case if you are not represented by someone who knows the law.
